Terms of Service

These Terms of Service govern any quote, estimate, or installation work performed by OpticPulse Network Solutions ("OpticPulse," "we," "us") for a customer ("you," "customer") in Niagara Falls, St. Catharines, and the surrounding Niagara region, Ontario. By requesting a quote, booking an appointment, or accepting our services, you agree to these Terms. Nothing here limits any rights you have under Ontario's Consumer Protection Act, 2002 — where these Terms and the Act conflict, the Act prevails.

1.What We Do

OpticPulse installs structured cabling and low-voltage infrastructure — including Ethernet/Cat6/Cat6A drops, fiber optic terminations, security camera cabling, Wi-Fi access point runs, patch panels, and rack builds — for residential, multi-unit, and small commercial clients across Niagara. We supply the cabling and installation materials as part of our service and install to ANSI/TIA and BICSI standards. We do not perform high-voltage electrical work; any electrical work required on your project must be completed by a licensed electrician.

2.Materials vs. Devices

Materials we supply

OpticPulse supplies new, cUL/CSA-certified cabling materials appropriate for the job — cable, faceplates, keystone jacks, termination ends, connectors, and patch panels — with the correct fire-rating (riser or plenum/FT6) for the space. These materials are itemized in your written estimate.

Devices you supply

You are responsible for supplying active devices — switches, routers, PoE cameras, NVR/DVR recorders, and Wi-Fi access points — of the correct type and quantity for your project, ensuring they are compatible with the cabling we install, and having them on-site and ready at the scheduled appointment time. We warrant our own workmanship and the cabling materials we supply — we do not warrant devices you supply yourself.

3.Cable Length Cap

A "drop" or "run" means one cable routed from origin to termination, including up to 50 ft (15 m) of cable, one keystone jack, and a faceplate where applicable. Additional cable beyond 50 ft is billed at $1.25 per foot, billed in whole feet. Premium media — Cat6A, shielded, or plenum/FT6-rated cable — adds a further $0.75 per foot. Expected run lengths are discussed and estimated at the time of quoting.

4.Estimates & Pricing

Estimates are free, provided in Canadian dollars (CAD), and valid for 30 days from the date issued. Each estimate itemizes labour and OpticPulse-supplied materials separately. In accordance with Ontario's Consumer Protection Act, the final price will not exceed the written estimate by more than 10% unless you agree in writing to the additional cost before it is incurred. HST is added to all invoices as required by law.

5.Booking & Deposits

Most jobs require a 10% booking deposit, which is applied directly to your final invoice. We never require full payment before work begins.

6.Cancellation, Rescheduling & No-Access

Cooling-off right: If you sign a contract with us at your home ("direct agreement" under Ontario's Consumer Protection Act), you may cancel it for any reason within 10 days of receiving your written copy of the agreement. If you cancel within this period, we will refund your deposit and any payment in full within 15 days — less the reasonable value of any work you specifically asked us to begin during the cooling-off period.

After the cooling-off period, the following fee schedule applies to cancellations, reschedules, and no-access appointments:

Fees may be waived at our discretion for genuine emergencies. If OpticPulse needs to cancel an appointment, you will receive a full deposit refund within 15 days or priority rebooking, your choice. If we have already purchased materials specifically for your job before a cancellation, you are responsible for the cost of any non-returnable materials plus applicable restocking fees.

8.Change Orders

Any change to the scope, price, or schedule of a job must be agreed in writing (email or text is sufficient) before the changed work is performed.

9.Hidden or Pre-Existing Conditions

OpticPulse is not responsible for concealed or unforeseeable conditions discovered during work, including blocked or collapsed conduit, inaccessible wall or ceiling cavities, unmarked utilities, asbestos or other hazardous materials, or pre-existing code violations. Where such conditions are found, we will issue a written change order before proceeding. If a customer fails to disclose a known hazard or concealed service, any resulting damage from drilling or routing in that area is at the customer's risk.

10.Workmanship Warranty

OpticPulse provides a 12-month workmanship warranty on our labour, starting from the date of completion. Cabling materials we supplied that prove defective will be replaced, with manufacturer warranties passed through where applicable. This warranty does not cover devices you supplied yourself, damage from misuse, accident, water, power surges, pests, third-party alterations to our work, or normal wear and tear. This warranty is in addition to, and does not limit, your rights under Ontario's Consumer Protection Act.

11.Payment

The remaining balance is due upon completion of the work. Overdue accounts (more than 14 days past due) accrue interest at 1.5% per month (18% per annum). OpticPulse reserves its lien rights under Ontario's Construction Act and may pause further work on accounts in arrears after written notice.

12.Insurance & Limitation of Liability

OpticPulse carries commercial general liability insurance; a certificate of insurance is available on request. Our total liability for any job is capped at the amount paid for that job. We are not liable for indirect or consequential losses, including lost profit, lost data, or downtime, except where such loss results from our negligence causing property damage or personal injury, or where the law does not permit this limitation. Nothing in this section limits any right that cannot be limited under Ontario's Consumer Protection Act.

13.Permits & Consents

Unless we agree otherwise in writing, the customer (or their general contractor) is responsible for obtaining any required permits, inspections, and landlord or condo board consents for the work.

14.Privacy

Our collection and use of your personal information is described in our Privacy Policy.

15.Disputes

We will respond to any written complaint within 30 days. These Terms are governed by the laws of Ontario and Canada. Nothing here limits your right to file a claim in Small Claims Court or a complaint with the applicable Ontario Ministry.

16.General

If any part of these Terms is found unenforceable, the rest remains in effect. The version of these Terms posted at the time you book applies to your job. Changes to a signed agreement require your consent. These Terms, together with your written estimate or work agreement, form the entire agreement between you and OpticPulse for the work described.
